By submitting an&nbsp;<a href="https://res.cloudinary.com/aflds/image/upload/v1736456659/Appellant_s_Opening_Brief_Final_7e8a6ab92b.pdf">appeal</a> to the Fifth Circuit, the Plaintiffs are asking the appellate court to reverse the&nbsp;<a href="https://casetext.com/case/bridges-v-the-methodist-hosp-1">decision</a> of the district court - seeking declaratory relief and damages resulting from the Defendants-Appellees’ (Defendants) COVID-19 “vaccine” mandate. This pivotal case for medical freedom has the potential to set a precedent for lawsuits across the country and for the countless Americans seeking justice from COVID tyranny.&nbsp;In April 2021, the Methodist Hospital System implemented a mandatory COVID-19 immunization policy for all of its employees and vendors. The Plaintiffs refused to comply and had their jobs or vendor privileges terminated. District Court Judge George C. Hanks, Jr. upheld the Defendants’ mandate, concluding that the Plaintiffs do not have a fundamental right to refuse vaccination and the COVID-19 “vaccine” mandates are rationally related to a legitimate state interest. In other words, the Defendants’ mandate was in the best interest of safety and stopping the spread of the virus.&nbsp;America’s Frontline Doctors maintains the position that these experimental mRNA injections are not vaccines. Failing to prevent infection or transmission, the COVID shots are personal medical treatments ONLY. Further, vast scientific research and evidence have proven these “vaccines” to be neither safe nor effective. The Tenth Circuit reasoned that a counseling session transforms speech into conduct and conduct is not protected by the First Amendment, finding instead that the discussion of all treatment options was “incidental speech.” However, merely labeling protected free speech as “conduct” does not change its character as free speech nor does it turn free speech into unprotected “incidental speech.”Further, the state’s law exhibits unconstitutional viewpoint discrimination by only allowing speech that affirms a child’s sexual orientation or gender identity while prohibiting alternative treatments. Viewpoint discrimination is when the government prohibits or disfavors one type of speech (a particular viewpoint) while permitting another type of speech (a different viewpoint), and is flagrantly illegal in the United States of America. The Petitioner must be free to engage in protected and confidential speech with her clients that is in the best interests of Colorado’s minor children. Doughty&nbsp;<a href="https://casetext.com/case/kennedy-v-biden-4/">ruled</a> that Robert F. Kennedy, Jr. and Children’s Health Defense have standing for their First Amendment direct censorship claims against the Defendants. A Fifth Circuit three-judge panel later&nbsp;<a href="https://law.justia.com/cases/federal/appellate-courts/ca5/24-30252/24-30252-2024-11-04.html">reversed</a> the lower court’s ruling, rejecting the Plaintiffs’ claims that allowing the ongoing censorship to continue will cause more human harm. Additionally, the panel held that Plaintiffs were deprived of all legal standing because the government allegedly halted its censorship of the Plaintiffs (voluntary cessation), and vacated the trial court’s preliminary injunction.&nbsp;America’s Frontline Doctors contend that the Fifth Circuit panel adopted an overly restrictive interpretation of legal standing and concurs with the Plaintiffs’ claims. Medical censorship kills. ”Voluntary cessation” does not remove “standing” under the jurisprudence (theory of law). This holding sets a precedent that would allow government actors to destroy any and all constitutional rights at will under the simple pretense of temporary compliance. Further, this illegal behavior has not ceased and is likely to recur.AFLDS attorney David Dalia states, “Trial judge Terry A. Doughty delivered a well-reasoned opinion based on the evidence. The Fifth Circuit’s dangerous and deeply erroneous ruling is contrary to the prevailing jurisprudence. The Respondents are being sued by the Biden-Harris administration over&nbsp;<a href="https://wapp.capitol.tn.gov/apps/BillInfo/Default.aspx?BillNumber=SB0001&amp;utm_source=substack&amp;utm_medium=email">SB1</a>, Tennessee’s law that prohibits “gender-affirming care” for minors. By submitting our&nbsp;amici curiae brief, AFLDS joins the Respondents in calling for SCOTUS to affirm the judgment of the U.S. Sixth Circuit Court of Appeals. In short, we are asking the High Court to allow the state of Tennessee to enforce its own law which protects the health and safety of children by prohibiting these dangerous interventions.The government (Petitioner) argues that the state’s law discriminates on the basis of sex, violating the Equal Protection clause of the 14th Amendment. However, simply assessing the lines drawn by SB1 reveals the absence of any sex-based classification. The law creates two groups: (1) minors seeking to use puberty blockers and cross-sex hormones for gender transition, and (2) minors seeking to use puberty blockers and cross-sex hormones for other medical purposes. Both groups include both sexes, defeating the government’s equal protection argument.AFLDS maintains that minors are incapable of giving true and legal&nbsp;<a href="https://americasfrontlinedoctors.org/about-us/issue-briefs/exposing-the-misinformed-consent-of-medical-mutilation">informed consent</a> to medical mutilation. The rapid expansion of the Medical Mutilation Industry represents a tremendous threat to our national identity, security and future. To address this growing threat, our lawmakers must take critical action by passing legislation that protects the Nation’s children and holds rogue doctors accountable for their crimes against humanity.It is clear that SB1 is a proper exercise of the police power of the State of Tennessee to regulate these dangerous interventions to protect Tennessee minors from the tragically predictable consequences of medical mutilation. This exercise of state police power is similar to the longstanding and accepted state regulation of abortions, female genital mutilations, psychosurgery, shock treatments, lobotomies, child sterilizations, assisted suicides, euthanasia and even tattoos. As the medical harms of these “treatments” are well documented, state regulation is not only completely lawful and appropriate, it is mandatory.AFLDS Attorney David Dalia states, “There’s an alarming likelihood that these minor children will bitterly regret these mutilations. Studies show that as many as 85% of children grow out of gender dysphoria! As I learned the reality of ‘gender-affirming care,’ I became appalled. Tennessee’s lawful exercise of its police power to protect minor children from lifetime mutilations should be strongly affirmed. Brown</a> sought to establish that the State’s mandate was unconstitutional and in violation of federal law. The Plaintiffs in&nbsp;Johnson assert that in the context of the experimental COVID “vaccine”, their right to refuse unwanted medication is determined by the&nbsp;<a href="https://www.nejm.org/doi/full/10.1056/nejm199711133372006">Nuremberg Code</a>, which requires informed consent without any element of duress. The district court dismissed the case, and the Ninth Circuit refused to address the merits of the constitutional issue, finding instead that the Defendants were entitled to qualified immunity. AFLDS Stands Against Medical Mutilation

A Great Day For Justice In America!Oakdale, LA. – July 24, 2024.&nbsp;The tremendous impact of SCOTUS’ historic&nbsp;<a href="https://aflds.org/about-us/press-releases/scotus-delivers-historic-fischer-v-usa-ruling">Fischer v. USA</a> ruling last month is being felt across the Nation as politically persecuted J6 defendants advance closer toward justice.&nbsp;&nbsp;&nbsp;On Wednesday, July 24, 2024, AFLDS Creative Director John Strand was released from prison after his Second Motion for Release Pending Appeal was&nbsp;<a href="https://storage.courtlistener.com/recap/gov.uscourts.dcd.227166/gov.uscourts.dcd.227166.154.0.pdf">granted</a> by United States District Judge Christopher Cooper. His release comes after the High Court ruled last month that the DOJ misused and inappropriately charged January 6 defendants with “obstruction of an official proceeding.” Strand was originally sentenced to 32 months of incarceration. He endured a horrific and grueling&nbsp; year-long prison term for four misdemeanor charges that were wielded against him.In total, John was charged with five counts for being present at the Capitol on January 6, a single felony and four misdemeanors. He was convicted by a Washington D.C. jury in September 2022. Among those charges was&nbsp;<a href="https://www.law.cornell.edu/uscode/text/18/1512">18 USC § 1512(c)(2)</a>, which was unquestionably weaponized by the DOJ to illegally overcharge J6 defendants with a 20-year felony for exercising their First Amendment right to protest the actions of their elected officials. AFLDS applauded SCOTUS for correcting the&nbsp;<a href="https://aflds.org/fischer">miscarriage of justice</a> that was perpetrated against John and the many hundreds of ordinary Americans across the country.&nbsp;This illegal overcharging led most defendants to quickly accept plea deals. In the face of a daunting prison sentence, John Strand boldly refused to bear false witness, including against himself, by confessing to a fraudulent plea.&nbsp;John was at the Capitol on January 6 as security detail for his co-defendant, Dr. Simone Gold, who was a scheduled speaker at a&nbsp;<a href="https://res.cloudinary.com/aflds/image/upload/v1685915669/Flyer_J6_qbqn6c.jpg">rally</a> with a government-approved&nbsp;<a href="https://res.cloudinary.com/aflds/image/upload/v1685966679/aflds/PERMIT-_One_Nation_Under_God_January_6_2021_nywbf7.pdf">permit</a>. All of his actions that day were captured on the Capitol closed-circuit&nbsp;<a href="https://twitter.com/JohnStrandUSA/status/1664660656899907585?s=20">video recordings</a>.&nbsp;Strand honorably and reasonably fulfilled his job&nbsp; by protecting Dr. Gold. He did not commit any unlawful or inappropriate acts. John injured no one, threatened no one, and caused no damage. He was respectful to the Capitol police. Despite this indisputable evidence, in June 2023, John was&nbsp;<a href="https://aflds.org/about-us/press-releases/political-apartheid-casualty-sentenced-to-32-months-in-federal-prison-for-protecting-a-woman-on-january-6">sentenced</a> to&nbsp;32 months in prison and 36 months supervised release.&nbsp;Although Judge Cooper acknowledged that Strand’s actions were non-violent, he appeared incensed over John’s persistence in exercising his First Amendment constitutional right to free speech. The judge singled John out for speaking publicly regarding the disparate treatment of J6 defendants in contrast to innumerable examples of recent Marxist-driven protests - openly punishing John for his political speech criticizing the government.&nbsp;John Strand&nbsp;<a href="https://twitter.com/JohnStrandUSA/status/1686396184334671872">self-surrendered</a> to begin his sentence at a federal prison last July, officially becoming a political prisoner in the United States of America. While in prison, Strand was thrown into solitary confinement for over four months because he took an interview while incarcerated to explain the inhumane conditions of J6 prisoners. As laid out in the United Nations Nelson Mandela Rules adopted by the General Assembly in 2015, solitary confinement for a time period in excess of 15 consecutive days is considered prolonged and is prohibited. Not only was John in isolation, the prison refused to allow any contact whatsoever, including refusing him access to his attorneys.&nbsp;The selective prosecution and imprisonment of John Strand is a true American tragedy and proof that the legalization of facism in our country is happening. However, John’s story proves that justice will prevail when good men and women take a stand for what they know is right.&nbsp;John reflects on his imprisonment, “The darkness and cruelty I faced were unimaginable. I drew strength from the Bible - specifically the story of Shadrach, Meshach and Abednego - young men who refused to bow to an idol and were thrown into a fiery furnace. Politically Persecuted J6 Defendants Advance Toward JusticeWashington, DC. – June 28, 2024.&nbsp;The High Court’s decision has brought down the entire house of cards that is the selective prosecution of the J6 defendants by the DOJ and has proven that the United States of America still operates under the rule of law.&nbsp;On&nbsp;Friday, June 28, 2024, SCOTUS delivered a 6-3 decision in&nbsp; the landmark&nbsp;<a href="https://www.supremecourt.gov/opinions/23pdf/23-5572_l6hn.pdf">Fischer v. USA</a> case. Chief Justice Roberts delivered the opinion of the Court, in which Thomas, Alito, Gorsuch, Kavanaugh, and Jackson joined. Jackson filed a concurring opinion. Barrett filed a dissenting opinion, in which Sotomayor and Kagan&nbsp; joined.“To prove a violation of Section 1512(c)(2), the Government must establish that the defendant impaired the availability or integrity for use in an official proceeding of records, documents, objects, or as we earlier explained, other things used in the proceeding, or attempted to do so. The judgment of the D. C. Circuit is therefore vacated, and the case is remanded for further proceedings consistent with this opinion. On remand, the D. C. Circuit may assess the sufficiency of Count Three of Fischer’s indictment in light of our interpretation of Section 1512(c)(2).” - Chief Justice RobertsAFLDS applauds SCOTUS for recognizing and correcting the tremendous&nbsp;<a href="https://aflds.org/fischer">miscarriage of justice</a> that was perpetrated on many hundreds of ordinary Americans across the country. The federal government’s weaponization of&nbsp;<a href="https://www.law.cornell.edu/uscode/text/18/1512">18 USC § 1512(c)(2)</a> was unquestionably used to charge the J6 defendants with a maximized 20-year felony and punish them for daring to exercise their first amendment right to protest the actions of their elected officials.To date, more than 355 J6 defendants have been unjustly charged with “corruptly” obstructing, influencing, or impeding an official proceeding, or attempting to do so. Many have been sentenced with prison time ranging from 8 months to more than 4 years - and over 100 are still political prisoners today.&nbsp;As stated by AFLDS’ affiliate attorney, David Dalia: “The statute at issue in&nbsp;Fischer, 18 U.S.C. § 1512, is titled ‘Tampering with a witness, victim or an informant.” 18 U.S.C. § 1512(c)(1) punishes anyone who ‘alters, destroys, mutilates, or conceals’ evidence. None of the J6 defendants tampered with any evidence. So it’s very gratifying that the Supreme Court in&nbsp;Fischer decided today that the (c) (2) residuary clause must be read narrowly ,&nbsp; and that the ‘otherwise’ provision of §1512(c)(2) is limited by the list of specific ‘evidence tampering’ criminal violations that precede it in (c)(1).&nbsp; The residuary clause does NOT extend to acts&nbsp;unrelated to evidence tampering, such as mere misdemeanor trespass.”Mr. Dalia continued, “This § 1512(c)(2) residuary clause was relentlessly stretched by the DOJ to overcharge the J6 defendants for mere misdemeanor trespass, unlawfully giving the DOJ powerful leverage to wring plea agreements from defendants under the threat of illegal and extremely lengthy felony prison terms.&nbsp;Although J6 defendants were incessantly branded by the mainstream media as ‘insurrectionists,’ not one person was ever charged with insurrection, which ‘only’ carries a 10 year prison term. Instead, all were charged with §1512(c)(2)’s 20-year prison term. Thankfully, this unjust overcharge was rejected today by SCOTUS. Now all of the J6 defendants are entitled to have their long jail sentences immediately recalculated. In the vast majority of cases, this should result in their release. Twitter complied within 5 minutes. Flaherty’s demands were sometimes accompanied by cursing and threats. Flaherty also demanded that Facebook immediately tell him why they weren’t removing COVID posts quickly enough when he instructed them to do so.&nbsp; Surgeon General Murthy similarly told Facebook that he wanted Facebook to do more to censor speech which he deemed to be misinformation, and demanded information that showed Facebook’s compliance with these demands. Dozens of other examples were entered into evidence. We are shocked that the Supreme Court is allowing this illegal and unconstitutional government censorship of free speech to continue while this case is pending.&nbsp;Our federal government targeted and silenced dissenting voices speaking out against the “approved” COVID-19 narrative. Clear evidence of such censorship was seen in July 2020 when AFLDS’ viral White Coat Summit video received 20 million views in 8 hours before being taken down across all social media platforms at the behest of Anthony Fauci. AFLDS and Simone Gold, M.D., J.D. file amici curiae brief in SCOTUS Case

The court’s decision will set a precedent for doctors nationwide and affect the longstanding sacred patient-doctor relationship. AFLDS Headquarters - Naples, FL – Nov. 9, 2023Dr. Simone Gold, the founder and president of America’s Frontline Doctors (AFLDS) recently filed a&nbsp;<a href="https://res.cloudinary.com/aflds/image/upload/v1699541967/Simone_Gold_v_CMB_COMPLAINT_1_piea9q.pdf" target="_blank" rel="noopener noreferrer">complaint </a>against the Medical Board of California (CMB), its president, Kristina Lawson, and 20 related board members (collectively, the “defendants”). Dr. Gold is suing the defendants in an effort to block the Board from illegally threatening the status of her California physician&nbsp; license, and to preserve her dignity, reputation, and her constitutionally-protected First Amendment rights to free speech and due process.The complaint alleges the defendants exceeded their authority in charging Dr. Gold with dubious allegations and are liable for six counts of unconstitutional and unlawful violations relating to their continued and unprovoked “investigations” of Dr. Gold. Kristina Lawson, in particular, acted with extreme personal vendetta.&nbsp;Attorneys for Dr. Gold maintain the defendants have no legal basis in fact to target her. This means she’s asking the court to 1) formally acknowledge the defendants have willfully and recklessly violated her constitutional rights; 2) prohibit them from any future investigations into her protected free speech; and 3) monetarily compensate her (and her attorneys) for depriving her of her right to practice medicine, defiling her personal and professional reputation, and for violating her constitutional rights.In July 2020, Dr. Gold and the original frontline doctors courageously stood on the steps of the Supreme Court, publicly denounced medical censorship and tyranny, and declared the truth about CV19. The&nbsp;<a href="https://aflds.org/videos/post/white-coat-summit-2020-flashback">event</a> was live streamed and viewed by an estimated 20 million viewers before internet controllers scrubbed the video from every media platform.&nbsp; In late December 2020, Dr. Gold requested and received a permit to speak at the U.S. Capitol on January 6&nbsp;(J6). About a month after her speech, she was violently arrested in her California home for alleged trespassing. After observing that all J6 defendants, including bystanders and observers, were being selectively persecuted with severe felony charges without evidence, Dr. Gold accepted a plea deal for a misdemeanor. For the first time in his judicial career, the J6 D.C. trial judge sentenced a nonviolent misdemeanant to 60 days in maximum security federal prison.&nbsp;Very surprisingly, it was revealed at Dr. Gold’s sentencing, that the president of the CMB, Kristina Lawson, had an extraordinary personal vendetta against Dr. Gold. Kristina Lawson wrote a four-page letter to the Judge filled with vitriol against Dr. Gold. At sentencing the Judge clearly indicated that the “crime” was not related to the practice of medicine. But the “investigations” by Kristina escalated. In August 2023, Dr. Gold received correspondence from the defendants that several of their “investigations” were “now closed.” Dr. Gold and her attorneys were never informed of any such investigations, which is required by law. The defendants’ claim that Dr. Gold’s speech on J6 is a “Conviction of a Crime Substantially Related to the Qualifications, Functions, or Duties of a Physician and Surgeon” and “General Unprofessional Conduct.” In its 147-year history, the CMB has&nbsp;never sought the removal of a doctor’s medical license for a misdemeanor trespass.&nbsp;The Medical Board of California typically sanctions doctors for highly egregious misdeeds related to the practice of medicine such as sexual abuse of patients, gross incompetence, or healthcare fraud.Dr. Gold is set for hearing before the California Medical Board on November 13. Her attorneys will argue that her misdemeanor conviction is not substantially related to her qualifications as a doctor and surgeon. Should Dr. Gold&nbsp;not prevail, there will be a new standard in California - that politically protected speech and a misdemeanor plea can cost a licensee their livelihood. This is extraordinarily dangerous.&nbsp;While the defendants expend valuable taxpayer funded resources and time to unlawfully pursue and threaten Dr. Gold, it’s important to note the agency has been derelict in their own statutory mission and authority. One of the primary roles of the CMB, which is backed by the Governor and the state’s legislative branch, is to protect the health and safety of Californians.
